Court sentences Salybia man to 3 years imprisonment with 2 year suspended sentence for indecent assault

Image via; Kirtok.comA thirty-eight (38) year old man of Salybia has received a three (3) year imprisonment sentence with a two (2) year suspended sentence for indecent assault of a minor by Justice Bernie Stephenson-Brooks on Monday.The defendant R. A; whose name cannot be published as ordered by Justice Stephenson- Brooks, was in a relationship with the mother of the eleven (11) year old girl at the time of the incident.According to the facts, on the 24th of December, 2009 the defendant was at the dwelling home of the victim’s mother along with the minor when he grabbed her buttocks while she was standing by the refrigerator having a drink of water. No words were exchanged between them at that time and the minor proceeded downstairs to the bathroom, where she met the defendant who had already gone downstairs. The victim was wearing only an underwear and a bath towel around her when the defendant pulled the towel, pulled her towards him with her back facing him and rubbed himself on her. The victim proceeded to take her shower and then informed her mother of the incident, who in turn confronted the defendant in the child’s presence. He apologized and begged for forgiveness however the mother made a report at the Castle Bruce Police Station.Counsel for the Defendant, David Bruney who pleaded to the Court on behalf of his client on the 12 of October, 2011 said that his client was sorry for his actions, a peaceful person, a first time offender who pleaded guilty at the first opportunity and did not allow the victim to go through a trial.Mr Bruney further pleaded with the Court that it should not impose a custodial sentence on his client but that some type of counseling be ordered particularly as he has shown great remorse for his “unfortunate actions”.Justice Stephenson-Brooks therefore ordered that a victim impact assessment be conducted by the Social Welfare Department. This report she said would assist the Court to determine the impact of the incident on the victim and her family as well as what kind of counseling would be appropriate for the defendant.At this morning’s sitting, Justice Stephenson-Brooks stated that she had taken into consideration the report submitted by the Social Welfare Department as well as the aggravating and mitigating factors in the matter.Justice Stephenson-Brooks before rendering her decision noted the impact of indecent assault on a victim stating that it can be a very traumatic experience for a victim as it often causes humiliation, distress, fear and abuse of a trusted relationship as in this case.She stated further that the degree of harm to the victim and the level of risk by the offender must also be regarded. R. A was therefore sentenced to three years imprisonment with a two year suspended sentence. He was also ordered to complete seventy-two (72) hours of community service before the 30th of June, 2012 or in default spend nine (9) months in prison.Justice Stephenson-Brooks further warned R.
